Hirschauer Backs Landmark Bill to Protect Immigrant Families and Uphold Constitutional Rights

SPRINGFIELD, Ill. — State Rep. Maura Hirschauer, D-West Chicago, passed a sweeping civil rights and community-protection bill last Friday to safeguard immigrant families and defend due process in the face of escalating immigration enforcement actions.

“We took a stand against the violence, the fear, and the trauma that has been unfairly and unlawfully unleashed onto our communities—a war inflicted to divide, dehumanize and silence so many Illinoisans,” said Hirschauer.

House Bill 1312 strengthens constitutional protections across Illinois by creating clear guardrails for civil immigration enforcement and ensuring that essential community spaces—hospitals, courthouses, universities, and licensed daycare centers—remain safe and accessible to all residents, regardless of immigration status. The bill further empowers individuals to seek justice when their constitutional rights, including those under the Fourth Amendment, are violated.

The legislation creates new pathways for accountability, allowing individuals to bring civil actions against civil law enforcement who violate their constitutional rights while engaging in civil immigration enforcement. House Bill 1312 also establishes policies that ensure state- licensed facilities and public campuses respond lawfully and responsibly to immigration activities, while protecting the privacy and dignity of those they serve.

“No one should fear losing their child, parent or loved ones to unaccountable, masked men. And particularly, no one in Illinois seeking care in a hospital room, justice from inside a courthouse, or simply picking up their toddler from daycare should ever be hunted down without due process. That is our constitutional right—a right we successfully affirmed—but should never have to. I’m honored to be a part of this historic legislation that finally draws the line on Trump’s unlawful actions.”

House Bill 1312 now moves to the Governor’s desk.

WEST CHICAGO, Ill. – State Rep. Maura Hirschauer, D-Batavia, was presented the 2025 Legislative Champion Award today from The Network: Advocating Against Domestic Violence for her work leading the passage of Karina’s Law, which took effect this spring.

“After years of fighting in Springfield and in the courts, and after extensive negotiation and advocacy, the passage of Karina’s Law marks a significant step forward in protecting domestic violence survivors from firearms,” Hirschauer said. “This survivor-centered law honors the memory of Karina Gonzalez and her daughter Daniela who were murdered by an abuser who should have never had access to a firearm. Although we cannot erase tragedies in the past, Karina and Daniela’s legacy will live on with each life they save with this law.”

Karina’s Law (House Bill 4144) combats the deadly combination of guns and domestic violence by strengthening the firearm remedy within the order of protection process and allowing judges to order the removal of guns from abusers who have been deemed a credible danger. The bill also clarifies the process for survivors, judges and law enforcement when the firearm remedy is involved in criminal and civil orders of protections.

After years of negotiation by Hirschauer and advocates, Karina’s Law was successfully signed by Governor Pritzker in February.

“We must work to build a better future in memory of victims, survivors, and all who love them. Karina’s Law is a long overdue step in that direction,” said Hirschauer. “Thank you to The Network for this recognition, but ultimately, thank you for continuing your advocacy and support for so many men and women who go through the unconscionable. Hirschauer Receives GPAC Award for Gun Violence Prevention Work

WEST CHICAGO, Ill. – Highlighting impactful advancements in public safety and preventative violence legislation, state Rep. Maura Hirschauer, D-Batavia, was awarded the 2025 Profile in Courage Award from the Gun Violence Prevention PAC (GPAC) Wednesday, October 15.

“Gun safety and gun ownership are not at odds. They go hand in hand. We all share the same goal—keeping firearms out of the wrong hands and preventing tragedies before they happen,” said Hirschauer. “I’m honored to be recognized by such a supportive organization that is steadfast in creating safer communities for our families and children.”

Hirschauer has led significant firearm reform in the Illinois General Assembly as the House Gun Violence Prevention Chair. Earlier this year, the Hirschauer-led Karina’s Bill (House Bill 4144) was passed into law, protecting survivors of domestic violence by ensuring firearms are removed when an order of protection is issued—preventing incidents from turning deadly. Hirschauer also led the passage of the Safe Storage Act (Senate Bill 8), first-of-its-kind legislation that codifies firearm storage so weapons are inaccessible to minors, individuals in crisis and those prohibited under Illinois or federal law from having one. The measure also strengthens firearm reporting (House Bill 850). Studies show that states with similar laws decreased unintentional shootings by children by 78% and the movement of illegal guns in communities by 46%.

“We all have an integral role in reforming our laws that can allow violent offenders to slip through the cracks. Together, we’re building a future where gun violence is no longer normalized, but stopped,” said Hirschauer. “Thank you to GPAC for this award and for shining a light on the urgent need for policy change. SPRINGFIELD, Ill. – State Rep. Maura Hirschauer, D-Batavia, is speaking out about the violent, corrupt, and illegal actions the Trump Administration is launching against Illinois residents, passing official condemnations of Trump’s efforts to disregard due process, incite political violence and silence free speech and the press.

“Public safety policies should be rooted in empathy, not fear. In my community, violence has taken the form of masked agents, blackhawk helicopters, and pepper spray. Donald Trump’s immoral use of federal agents is not protecting our community from criminals; ICE is abducting fathers on their way home from school drop-off, aunts and uncles leaving a shift at a local factory, college students attending early morning classes,” said Hirschauer.

After one of the most volatile summers in our nation’s history, Hirschauer began the fall legislative session speaking out for constitutional rights, for due process of law, and for communities where everyone can feel safe.

Hirschauer voted to: 

  • Condemn acts of political violence—whether that violence is in the form of mass shooters and radicalized extremists, or is inflicted by masked troopers deployed by the federal government. (House Resolution 508)
  • Call out Donald Trump’s racial profiling, violent tactics including chemical munitions and illegal search and seizure, and the disregard for the due process protections cited in the United States Constitution. (House Resolution 504)
  • Rebuke Donald Trump’s corrupt efforts to exert control over news media by abusing executive powers to punish dissent and reward compliance—restricting the right to free speech and endangering the local press. (House Resolution 505)

“We are witnessing something deeply un-American. I never would have imagined protecting my community from violence and hate inflicted by our own government. Illinois will not be a stage for that kind of fear. We stand for public safety, not the will of a convicted felon,” said Hirschauer. “Empathy has been at the heart of every political and policy decision that I have made and it will continue to guide my practice.”

“Do not turn away.”

That’s what I tell people who pass through our community of West Chicago on Route 59 or Route 38 on their way to other places. Take a detour, and explore our historic community that was built up and around the railroads, and by immigrants from all over the globe. Wander through our downtown, grab a strong coffee from our local coffee shop, enjoy homemade gorditas and deliciously soft concha.

West Chicago is normally a quiet town, but if you look closer you will now see unmarked SUVs, trucks and vans with tinted windows patrolling our tree lined streets, circling neighborhood schools, spreading fear with every turn. Do not turn away. These are ICE agents, and they are here simply because West Chicago is a largely Latino community. They are not armed with judicial criminal warrants; they are armed with guns and pepper spray. These agents are not protecting our community from criminals; they are abducting fathers on their way home from school drop-off, aunts and uncles leaving a shift at a local factory, college students attending early morning classes.

Do not turn away—pay attention to the cries of our neighbors. They have been living peacefully, working hard, paying taxes, raising their families, going to church. The vast majority of people here are citizens, while others dream of a path. Everyone in West Chicago now feels as if their world has turned upside down. They are terrified of leaving their house and never seeing their children again. They are not criminals—they are your neighbors and ICE is holding them hostage.

The federal administration’s deployment of ICE in our peaceful neighborhoods is not keeping us safe, in fact it is doing quite the opposite. There is no part of “Operation Midway Blitz” that is aimed at solving the systemic issues in our immigration system. Instead, the “blitz” has left our families and neighborhoods vulnerable. Unaccountable, masked ICE agents are undermining years of work by our law enforcement to build trust with the communities they serve. Families are too afraid to call the police – even in dire emergencies. The fear tactics of ICE have forced our neighbors to think twice before calling for help.

Our current immigration policy is broken, and instead of rolling up his sleeves, doing the work of governing, and offering solutions to fix it, President Trump is choosing to target and torture the very immigrant community that weaves the fabric of this nation. It is a cowardly and weak choice, and above all it is a dangerous one. Every single person in our community is put in harm’s way when ICE agents roam our neighborhoods. 

Sadly, our community is not alone. ICE agents are terrorizing communities throughout our state; towns like Elgin, Aurora, Franklin Park, Glendale Heights and Addison; and neighborhoods throughout the city of Chicago.

Please, do not turn away. Witness the educators, administrators and childcare workers who are working overtime—arriving early and staying late—to ensure that students are safely cared for during the school day. Notice the factory workers, who despite the real fear of ICE abduction, continue to show up to do their essential jobs and keep our economy moving. Recognize the laborers who persist on job sites building integral infrastructure, or maybe even improving and repairing your own home. Observe the small business owners who open their doors even as the threat of ICE looms.

Do not turn away, take action. Join community members who have organized to keep watch, document stops, and support each other through fear and uncertainty. Donate to your local foodbank. Shop and eat at immigrant owned businesses and restaurants. And most importantly, spread truth. ICE is not in our community serving judicial criminal warrants. ICE is not detaining violent offenders. Instead, they are stripping away due process rights, profiling people simply based on the color of their skin, and forcing entire communities to live in fear. That does not keep our communities safe—we do. Please join us.

Hirschauer Safe Gun Storage Bill Becomes Law

WEST CHICAGO, Ill. – Working to keep firearms out of the wrong hands and prevent accidental shootings, state Rep. Maura Hirschauer, D-Batavia, successfully passed the Safe Gun Storage Act into law Monday. The new law works to keep guns out of the wrong hands, protect children from unintentional shootings, and track lost and stolen firearms by codifying ‘safe storage’ practices widely used by Illinois firearm owners.

“Safe firearm storage and responsible gun ownership are practices on which all of us, gun owners and non-gun owners alike, can agree,” said Hirschauer. “Senate Bill 8 is a common-sense gun safety measure that enhances safe firearm storage requirements and strengthens the reporting and data collection processes for lost and stolen guns.”

Hirschauer’s Senate Bill 8, known as the Safe Gun Storage Act, will enhance gun storage safety and address stolen firearm requirements with the ultimate goal of preventing access to firearms by minors, at-risk individuals, and those prohibited from possessing them. The bill would require firearm owners to secure their weapons in a locked container, rendering them inaccessible and unusable to anyone except the owner or an authorized user.

Additional provisions in a companion bill, House Bill 850, will tighten the reporting requirements for lost and stolen guns. House Bill 850 was signed into law last month.

“By promoting responsible gun ownership, this bill aims to prevent unauthorized access to firearms — helping reduce unintentional injuries, suicides, and acts of intentional harm, including school shootings," said Hirschauer. “This is a big step in promoting universal firearm safety and storage, and will ultimately save lives.”

CHICAGO, Ill. – This morning, Governor J.B. Pritzker signed State Representative Maura Hirschauer’s(D-Batavia) Safe Gun Storage Act into law. The culmination of a tireless fight by advocates and legislators, the Safe Gun Storage Act(SB8) ensures household firearms are kept out of the hands of children, teenagers, and criminals through tighter storage requirements and increased regulations on reporting lost or stolen firearms.

“Safe firearm storage and responsible gun ownership are practices on which all of us, gun owners and non-gun owners alike, can agree. SB 8 is a commonsense gun safety measure that enhances safe firearm storage requirements and strengthens the reporting and data collection processes for lost and stolen guns,” said Hirschauer. “By promoting responsible gun ownership, this bill aims to prevent unauthorized access to firearms—helping reduce unintentional injuries, suicides, and acts of intentional harm, including school shootings.”

The Safe Gun Storage Act requires firearms to be properly locked away when in a household with children, at-risk individuals, or those ineligible to receive FOID cards. Additionally, the act mandates that stolen or missing firearms are reported to local law enforcement within 48 hours of the discovery. Illinois State Police will now be able to revoke a FOID card if a gun owner fails to report a lost or stolen gun more than twice.

El gobernador Pritzker firma el proyecto de ley de almacenamiento seguro de Hirschauer

Cook County, IL –  The Veterans Assistance Commission of Cook County(VACCC) has announced the expansion of their Emergency Financial Assistance Program to better support veterans in need. Find details on the benefits below:

  1. Qualified veterans can now receive $100 towards past due phone and internet bills, both of which can be used once every 12 months
  2. Hygiene Assistance can now be accessed every 6 months instead of once a year
  3. The Food Assistance Program has been doubled! Eligible veterans will now receive two $100 Aldi gift cards, as well as an additional $100 gift card for each dependent and spouse
  4. The Rent and Mortgage Assistance cap has been raised from $1,400 to $2,000 to account for rising housing costs
  5. Families can now receive $3,000 in Funeral and Burial Assistance, up from $1,500 previously

WEST CHICAGO, Ill. – In an effort organized by the Veterans Survivor Coalition, State Rep. Maura Hirschauer, D-Batavia, joined over 400 veterans organizations, state, and local officials around the country in signing onto a bipartisan letter supporting legislation to expedite the issuing of a veteran’s death certificate. 

The letter explains how families of deceased veterans are subject to waiting times of four to eight weeks before death certificates are signed, preventing grieving families from accessing benefits, making arrangements, and coming to terms with their loss. HR 4398, which has recently been introduced by Minnesota Congressman Tom Emmer, goes even further, seeking to reduce this burden by requiring Department of Veteran Affairs(VA) physicians to sign death certificates for veterans who pass from natural causes within 48 hours of notification (a shorter timeframe than the 72 hours requested in the Veterans Survivor Coalition letter). 

Representative Hirschauer looks forward to seeing Illinois’ Congressmembers also signing on to this legislation to support our Veterans and their families.

“Dear Representative Emmer: 

On behalf of the over 400 veterans organizations, state and local officials, covering all 50 states, who advocate for the dignity and well-being of our veterans and their families, we strongly support legislation requiring Department of Veterans Affairs (VA) physicians to sign the death certificate of a veteran who passes away of natural causes within 72 hours of notification. 

Today, far too many veteran families are burdened by avoidable delays during one of the most difficult moments in their lives. Under the current system, it can take four to eight weeks for a death certificate to be signed—often by a medical examiner unfamiliar with the veteran, rather than the VA physician who cared for them. This delay prevents grieving families from accessing survivor benefits, settling estates, and gaining closure, compounding their emotional loss with unnecessary financial and logistical stress. 

This is not a complicated issue—it is a solvable one. VA physicians, who served as the veteran’s primary care providers and know their medical history, should be the ones to sign the death certificate promptly. Requiring this to happen within 72 hours of notification would offer a timely, compassionate resolution and remove a heavy burden from families who have already sacrificed so much. 

We extend our sincere thanks to you for taking the lead on this critical piece of legislation. Your leadership reflects a deep and unwavering commitment to the men and women who serve in our armed forces. From the moment they take their oath to the moment they are laid to rest, you have stood by them and their families—ensuring their service is honored not just in words, but through action. Your support is a powerful reminder that our nation’s duty to our veterans does not end when their service does. 

This legislation is a clear example of bipartisan compassion and commonsense reform. We urge Congress to move swiftly to pass it, ideally under unanimous consent, and give our veteran families the respect and support they deserve.

WEST CHICAGO, Ill. –  Recently championing a landmark safe storage bill out of the Illinois House and Senate chambers, state Rep. Maura Hirschauer, D-Batavia, is highlighting the importance of safe firearm storage by promoting ASK Day to normalize and spread awareness about asking about unlocked guns where children play. 

“So many firearm-involved tragedies can be prevented by encouraging safe storage already widely used by responsible gun owners,” said Hirschauer. “ASK Day is a simple but impactful campaign that normalizes the conversation of whether guns are in someone’s home, and ensures that our little ones won’t have access to them. Asking about guns in the home and volunteering information about how your guns are stored helps create dialogues and trust to ensure that our kids are safe from unintentional shootings, and other incidents of firearm misuse.”

ASK Day is June 21st and encourages parents and guardians to ask about unlocked guns where their children play. Launched in 2000 at the Million Mom March, the ASK (Asking Saves Kids) campaign has been a successful collaboration between Brady and the American Academy of Pediatrics to educate parents about the significant risks of children having access to guns in the home. 

ASK Day comes at the heels of a Hirschauer-led safe storage measure passed last month, expected to be signed by the governor later this year. Senate Bill 8, known as the Safe Gun Storage Act, enhances gun storage safety with the ultimate goal to prevent access to firearms by minors, at-risk individuals, and those prohibited from possessing them. The bill would require firearm owners to secure their weapons in a locked container, rendering them inaccessible and unusable to anyone except the owner or an authorized user.

“Almost five million kids nationwide live in a home with a loaded unlocked gun. ASK Day serves as a reminder that we can prevent tragedies simply by asking parents and caretakers ‘is there an unlocked gun where my child plays?’ This is a conversation that can save lives. And by normalizing this healthy communication between parents and kids around safe gun storage — everyone benefits,” said Hirschauer.

WEST CHICAGO, Ill. – Tras impulsar recientemente un proyecto de ley histórico sobre almacenamiento seguro en las cámaras de la Cámara de Representantes y el Senado de Illinois, la representante estatal Maura Hirschauer, demócrata por Batavia, destaca la importancia del almacenamiento seguro de armas de fuego al promover el Día ASK para normalizar y difundir la importancia de preguntar sobre armas desbloqueadas en los lugares donde juegan los niños.

“Muchas tragedias relacionadas con armas de fuego se pueden prevenir fomentando el almacenamiento seguro, una práctica ya generalizada entre los propietarios responsables de armas”, declaró Hirschauer. “El Día ASK es una campaña sencilla pero impactante que normaliza la conversación sobre si hay armas en casa y garantiza que nuestros pequeños no tengan acceso a ellas. El proyecto de ley exigiría a los propietarios de armas de fuego guardarlas en un contenedor cerrado con llave, haciéndolas inaccesibles e inutilizables para cualquier persona, excepto para el propietario o un usuario autorizado.

Casi cinco millones de niños en todo el país viven en hogares con armas cargadas y sin seguro. El Día ASK sirve como recordatorio de que podemos prevenir tragedias simplemente preguntando a los padres y cuidadores: “¿Hay un arma sin seguro donde juega mi hijo?”.
